Overview
ECE Planning secured consent, at appeal, for three five-bedroom detached dwellings on behalf of Martin Grant Homes. The appeal was brought in response to Horsham District Council’s refusal of permission on the grounds that the proposals represented over development of the site and would have adverse impact on the character of the area.
Responding to those grounds for refusal, ECE Planning successfully demonstrated that Horsham District Council did not possess a five-year housing land supply and, therefore the development must be considered in accordance with the National Planning Policy Framework alone.
Agreeing with ECE Planning’s conclusion with regards to housing land supply, the Planning Inspector also dismissed that Council’s objections in relation to design and residential amenity.
In addition to allowing the appeal, the Inspector ruled that Horsham District Council had not met the necessary requirements in demonstrating the need for contributions and, therefore removed any requirement of the development to provide contributions.
